Is a Destination Wedding Legally Valid?
Yes, a marriage performed abroad can be recognized in Quebec and Canada. It must comply with the rules of the country where it takes place and the legal requirements applicable to both partners, including their capacity to marry and their free and informed consent. A legally valid marriage performed abroad generally does not need to be performed again when you return.
It is important to distinguish a legal marriage from a symbolic ceremony. A symbolic ceremony celebrates your commitment but does not, on its own, legally marry you. You can choose to marry legally in Quebec, then celebrate your commitment with loved ones at your destination.
What Documents Should You Prepare?
There is no universal checklist: requirements depend on your destination and personal circumstances. Local authorities may request:
- A valid passport
- A birth certificate or official copy of your birth record
- A sworn statement confirming your marital status
- A marriage search letter
- A divorce certificate if you were previously married
- Your previous spouse’s death certificate if you are widowed
- Other documents or medical tests required locally
Official translations and document authentication may also be required. Confirm the exact requirements with the destination’s embassy, consulate or competent local authority before departure.
What Should You Do After the Wedding?
Keep the official marriage document issued by the local authorities. For Quebec residents, entering this document in Quebec’s register of civil status can simplify administrative procedures. This registration is generally not required for the marriage to take legal effect.
The application requires the original official marriage document, identification and proof of residence, along with other documents depending on your circumstances. If the marriage document is in a language other than French, Quebec’s Directeur de l’état civil requires a French translation prepared or certified by an OTTIAQ member.
